The short version
  • We only receive your personal data when you send us an enquiry, email us or become a client.
  • Google advertising and analytics cookies are used only if you allow them — and only if they are switched on for this site at all.
  • Campaign information (such as which ad or page brought you here) stays in your browser and is only sent to us together with an enquiry you choose to submit.
  • We never sell your data, and you can ask us to see, correct or delete it at any time: hello@binkmedia.co.

1. Who we are

This website, binkmedia.co, is operated by Bink Media, a business established in the Netherlands. Bink Media is the controller of the personal data described in this policy, which means we decide why and how it is processed and we are responsible for protecting it.

We have not appointed a Data Protection Officer, as this is not required for a business of our size and activities. Questions about privacy can be sent to hello@binkmedia.co.

2. What this policy covers

This policy applies to personal data we process when you:

  • visit binkmedia.co;
  • send us an enquiry or request a package or proposal;
  • email or call us; or
  • become a client, or act as a contact person or expert spokesperson for a client.

When we work on a client’s website we may have access to tools such as Google Search Console, analytics or a content management system. That information is largely aggregated and non-personal. Where it does include personal data, we process it on the client’s behalf and under the client’s instructions, as agreed in our client agreement or a separate data processing agreement — in that situation the client’s own privacy policy applies to its visitors.

3. Personal data we collect

3.1 Information you give us

When you submit an enquiry through one of our forms, we receive:

  • your name and email address;
  • your company name and website address;
  • your country or market (for example United States, United Kingdom or Canada);
  • the package or service you selected, if any;
  • your message; and
  • for Digital PR enquiries, your industry and area of expertise.

If you email or call us, we receive your contact details and whatever you choose to share. If you become a client, we also process billing contact details, invoice and payment records, the agreement itself, and the correspondence and approvals that are part of delivering the work. For Digital PR clients this includes information about the expert spokesperson — such as name, job title, professional background and the expert comments you approve for submission to journalists.

3.2 Source page and campaign information

To understand which pages and campaigns lead to enquiries, our website records the following in your browser’s session storage (under the key bm-attr) when you arrive:

  • the page you first landed on and the website that referred you (the referrer);
  • campaign tags in the link you followed (UTM parameters such as source, medium and campaign); and
  • Google Ads click identifiers, if present in the link (gclid, gbraid or wbraid).

This information stays in your browser and is deleted automatically when you close the tab or window. It is only sent to us if you submit an enquiry, in which case it is stored together with your enquiry. It is not shared with Google or any other third party from our website.

3.3 Technical data

Like any website, our server receives technical information when you visit, such as your IP address, browser type, device information, the pages requested and the date and time. Our hosting provider uses this to deliver the site and keep it secure, and we use it to detect and prevent spam and abuse of our forms.

3.4 Preferences stored on your device

We store a small number of preferences in your browser’s local storage so the site works the way you expect: the pricing region you chose (bm-region), your cookie choices (bm-consent) and, if you submit an enquiry, a reference that prevents the same enquiry from being counted twice (bm-conv-sent). These are described in our Cookie Policy.

3.5 Analytics and advertising (only with your consent)

If Google Ads conversion measurement or Google Analytics is enabled on this site, Google cookies are only set after you give consent through our cookie banner. We use Google Consent Mode v2: until you consent, these tools are told that advertising and analytics storage is denied. See section 6 and our Cookie Policy.

3.6 Information from other sources

When we review an enquiry, we look at publicly available business information — mainly your website — so we can give you a relevant answer. We do not buy personal data from data brokers.

4. Purposes and legal bases

We only use personal data where the GDPR (and, for UK residents, the UK GDPR) gives us a legal basis to do so:

PurposeData usedLegal basis
Answering your enquiry and preparing a proposalEnquiry and contact details, correspondenceSteps taken at your request before entering into a contract (Art. 6(1)(b)); for enquiries on behalf of a company, our legitimate interest in responding to business enquiries (Art. 6(1)(f))
Delivering our services and managing the client relationshipClient contact details, agreement, approvals, correspondence, spokesperson informationPerformance of a contract (Art. 6(1)(b)); legitimate interests where the contract is with your employer (Art. 6(1)(f))
Invoicing, bookkeeping and tax complianceBilling details, invoices, payment recordsLegal obligation (Art. 6(1)(c))
Understanding which pages and campaigns lead to enquiriesSource page and campaign information submitted with an enquiryLegitimate interest in measuring and improving our marketing (Art. 6(1)(f))
Operating the website securely and preventing spam and abuseTechnical dataLegitimate interest in a secure, working website (Art. 6(1)(f))
Remembering your region and cookie choicesPreferences stored on your deviceLegitimate interest; storage strictly necessary to provide the service you request
Google Ads conversion measurement and Google AnalyticsCookies and online identifiers set by GoogleYour consent (Art. 6(1)(a)), which you can withdraw at any time
Establishing, exercising or defending legal claimsRelevant recordsLegitimate interest (Art. 6(1)(f))

Where we rely on legitimate interests, we have weighed those interests against your rights and you can object at any time (see section 9). We do not use automated decision-making or profiling that produces legal or similarly significant effects. We do not send marketing newsletters; if that ever changes, we will ask first where the law requires it.

5. Who we share data with

We do not sell or rent personal data. We share it only where necessary, with:

  • Our hosting provider, which runs the website and the server that receives form submissions.
  • Our transactional email provider, which delivers enquiry notifications to us and confirmation emails to you.
  • Email, office and file-storage software providers we use to communicate and to store client records.
  • Our accountant and accounting software, for invoicing and tax compliance.
  • Google (Google Ireland Limited and Google LLC), only if you consent to advertising or analytics cookies.
  • Journalists and publications — for Digital PR clients only, and only the expert comments and spokesperson details you have approved for submission. Journalists and publishers are independent; once something is published, its further use is outside our control.
  • Professional advisers and authorities — lawyers or auditors where needed, and public authorities where we are legally required to disclose information.

Service providers that process personal data on our behalf (processors) do so only on our instructions and under a data processing agreement as required by Article 28 GDPR. Journalist-request platforms such as Help a Reporter Out (HARO), Qwoted or Featured are independent services with their own terms and privacy policies; we are not affiliated with them.

6. Cookies and browser storage

We use essential browser storage to run the site and, only with your consent, Google cookies for advertising conversion measurement and analytics. When no Google tag is configured for this site, we set no non-essential cookies at all and no cookie banner is shown. Full details, including names and durations, are in our Cookie Policy. You can change your choices at any time using “Cookie settings” in the footer.

7. International transfers

We are based in the European Union, and we aim to keep personal data within the European Economic Area (EEA). Some of the providers we use, such as Google or our email providers, may process data in other countries, including the United States. Where that happens, we make sure appropriate safeguards are in place, such as:

  • an adequacy decision of the European Commission (including the EU–U.S. Data Privacy Framework, where the provider is certified);
  • the European Commission’s Standard Contractual Clauses (SCCs); and
  • for data relating to UK residents, the UK International Data Transfer Addendum or an equivalent UK mechanism.

If you are a client in the United States, United Kingdom or Canada, your data is necessarily handled by us in the Netherlands. You can ask us for more information about the safeguards we rely on.

8. How long we keep data

We keep personal data only as long as we need it for the purposes above:

DataRetention
Enquiries that do not lead to an agreement (including submitted campaign information)Up to 24 months after our last contact, then deleted
Client agreements, invoices and financial records7 years, as required by Dutch tax law
Client correspondence and project recordsFor the duration of the client relationship and up to 24 months afterwards, unless part of the financial records above
Server and security logsA limited period set by our hosting provider, normally no longer than needed for security and troubleshooting
Campaign information in session storage (bm-attr)Until you close the browser tab or window
Region and cookie preferences in local storageUntil you change them or clear your browser storage
Google cookies (only with consent)As listed in our Cookie Policy

We may keep data longer if needed to comply with a legal obligation or to establish, exercise or defend a legal claim.

9. Your rights

Under the GDPR and the UK GDPR you have the right to:

  • access the personal data we hold about you and receive a copy;
  • rectify data that is inaccurate or incomplete;
  • erase your data (“right to be forgotten”), where there is no overriding reason for us to keep it;
  • restrict our processing in certain circumstances;
  • object to processing based on our legitimate interests;
  • data portability — receive data you provided in a structured, commonly used format; and
  • withdraw consent at any time, without affecting processing that took place before you withdrew it.

To exercise any of these rights, email hello@binkmedia.co. We may ask you to confirm your identity before acting on a request. We respond within one month; for complex requests this can be extended by up to two further months, in which case we will tell you why. Exercising your rights is free of charge.

You can withdraw consent for cookies at any time through “Cookie settings” in the footer or on our Cookie Policy page.

10. California and Canada

California residents

Depending on whether California privacy law applies to us, California residents may have the right to know what personal information we collect and how we use it, to request deletion or correction, and to opt out of the sale or sharing of personal information. We do not sell personal information. Advertising cookies are only set after you opt in, and you can withdraw that consent at any time. We will not discriminate against you for exercising your rights. Requests can be sent to hello@binkmedia.co.

Canadian residents

We handle personal information in line with the principles of Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA): we collect it for identified purposes, with your knowledge and consent where required, and you may request access to and correction of your information or withdraw consent, subject to legal and contractual restrictions. Your information is processed in the Netherlands, as described in section 7.

11. Complaints

If you are unhappy with how we handle your personal data, please contact us first — we would like the chance to put it right. You also have the right to lodge a complaint with a supervisory authority:

  • in the Netherlands: the Autoriteit Persoonsgegevens (Dutch Data Protection Authority);
  • in the United Kingdom: the Information Commissioner’s Office (ICO);
  • in Canada: the Office of the Privacy Commissioner of Canada; or
  • the data protection authority in the EU country where you live or work.

12. Security

We take appropriate technical and organizational measures to protect personal data, including encrypted connections (HTTPS) for the whole website, access limited to the people who need it, strong authentication on the accounts we use, collecting only the data we need, and data processing agreements with our service providers. No system is completely secure; if a data breach occurs that poses a risk to you, we will notify the relevant authority and, where required, you.

13. Children

Our services are intended for businesses and are not directed at children. We do not knowingly collect personal data from anyone under 16. If you believe a child has sent us personal data, please contact us and we will delete it.

14. Changes to this policy

We may update this policy when our services, tools or legal requirements change. The “Last updated” date at the top shows when it was last revised. If we make significant changes that affect clients, we will also let them know by email.

15. Contact us

For any question about this policy or your personal data, email hello@binkmedia.co or contactBink Media using the details in section 1.
